Terms of use

What you may do with fcp2aaf, what you can expect from us, and what happens when something goes wrong. Written to be read: if a clause here is unclear, ask, and it will be explained rather than defended.

Who this agreement is with

fcp2aaf is an independent software project, operated from Mexico by its sole developer — we and us on this page. You is whoever installs the application, takes part in the beta, or buys a licence.

The address for anything to do with these terms is support@cesareho.com. The registered particulars behind the project — the full legal name, the tax identification and the postal address — are not published here, and are supplied in full, by return, to anyone who asks for them: a customer, an accounts department, a supplier questionnaire, or an authority.

Installing the application, joining the beta or buying a licence means these terms apply to you. If you do not accept them, do not install it.

The beta programme

Beta testers get 60 days of full access at no cost. The 60 days start when the build is sent, not when the application is written for.

A beta is pre-release software. It can crash, it can refuse a document it should accept, and it can write a delivery that is wrong in a way the report does not catch. Open every delivery in your DAW and check it before it goes to a mix. Do not make a beta build the only thing standing between you and a deadline you cannot miss.

A beta build stops working at the end of its period. Taking part does not entitle you to a licence afterwards, does not fix the price you will be offered, and does not oblige us to release the application at all.

The free plan

Timelines up to 5 minutes convert with every feature switched on, for as long as the application exists. It does not expire, it is not counting anything down, and it is not a sample of a better version.

It is also how you decide whether to pay. Every feature a licence unlocks is already in front of you on the free plan — the only thing a licence changes is how long a timeline may be. That is deliberate, and it is why the refund section below is written the way it is.

What a future version includes may change. A version you already have goes on doing what it did on the day you installed it.

Your licence

Buying grants you a personal, non-exclusive, non-transferable right to use the application. A 3-Day Pass lasts 72 hours from the purchase, not from first use. A Lifetime licence does not expire.

A licence is active on one Mac at a time and can be moved to another as often as you like: enter the same key on the new Mac, release the seat the old one is holding, and carry on. There is no cap on the number of moves and there is never a second licence to buy.

Using it on paid work, for your own clients, in a facility or as a freelancer is exactly what it is for and needs no other permission. What is not permitted:

  • sharing, selling, renting, publishing or sublicensing your licence key
  • using one licence to run a conversion service other people pay to send work through
  • removing, defeating or working around the part of the application that checks the licence
  • redistributing the application, or a modified copy of it

Buying, prices and tax

Purchases are made through Dodo Payments, who act as merchant of record. That means Dodo is the seller for your transaction: they take the payment, they issue the invoice or receipt, and they calculate, collect and remit whatever sales tax, VAT or IVA applies where you are. Their terms govern the transaction itself; these terms govern the software you receive.

We never see, handle or store card details. What reaches us is the order, your email address, and the licence record it created.

Prices on this site are published in US dollars. Your card may be charged in your own currency at checkout, at a rate Dodo and your bank set between them, and tax is added at checkout rather than shown in the price on the pricing page.

The licence key is emailed as soon as the payment clears. If it has not arrived within a few minutes, look in the spam folder first and then write — an order that was paid for and produced no key is fixed by hand, not by rebuying.

Refunds

The free plan exists so that nobody has to pay to find out whether this works for them. Every feature is in it; the only thing a licence changes is the 5-minute ceiling. Convert something real before you buy and a refund should never be necessary.

It still is sometimes, so: within 14 days of the purchase, if the application does not do what this site says it does and we cannot fix it for you, you get all of your money back. Write to the address below with the order number and what went wrong. There is no form and nothing to argue about.

Two honest limits. A 3-Day Pass bought, used to deliver a project and then refunded is not a refund, it is a free pass, and that request will be declined. And the same goes for a change of mind about the price after the work is done — a refund is for something that did not work, not for something that did.

None of that touches the rights the law gives you. If you are a consumer in Mexico, the Ley Federal de Protección al Consumidor applies. If you are in the EU or the UK, you have a statutory withdrawal right for digital content — one which you may be asked to waive at checkout in order to get the licence key immediately, and which is lost if you do. Wherever you are, whichever of these gives you more is what applies, and nothing on this page reduces it.

Updates, and what “lifetime” means

A lifetime licence includes every version we ever ship: no upgrade fee, no paid major version, nothing to buy twice. It is a promise that you will not be charged again, not a promise that development continues forever — nobody can honestly make the second one.

The application does not install updates behind your back. It can tell you one exists; installing it is your decision.

Your material, and what comes out

Your timelines, your media and every AAF the application writes are yours. We claim no rights over any of it, we take no licence to it, and — since the conversion runs on your machine — we never see it in the first place.

You are responsible for having the right to convert what you convert. What the application does is read files you already have and write new ones beside them.

What is guaranteed, and what is not

The application is provided as it is. It does what this site and the manual say it does, and every release is tested by opening its deliveries in the DAWs named on this site.

A conversion is a translation between two formats that do not match one another feature for feature. Some things cannot travel, and the report that ships with every delivery says which ones — that report is the guarantee, rather than a claim that everything always arrives.

We cannot guarantee how third-party software behaves, now or in a future version of it. Open the delivery in your DAW and look at it before you hand it over. That is true of every interchange format and every tool that writes one, this one included.

Liability

We are not liable for indirect or consequential loss: work you have to redo, a deadline you miss, a session booked twice, revenue you did not earn.

Where liability cannot be excluded, it is limited in total to the amount you paid us in the twelve months before the claim. On the free plan and on a beta build, that amount is nothing.

Nothing here excludes liability that the law does not allow anyone to exclude — fraud, death or personal injury caused by negligence, and the rights a consumer has by statute.

The site, the licence server, and being offline

Converting does not need the network. Activating a licence does, and so does checking it from time to time.

There is no uptime commitment for this website or for the licence server; both may be interrupted for maintenance or for reasons upstream of us. An activated Mac holds a signed authorisation that stays valid for weeks, so a short outage on our side is not a stopped delivery on yours.

They are used here only to say what this application is compatible with. fcp2aaf is an independent product and is not affiliated with, endorsed by, sponsored by or in any way approved by any of those companies.

Changes to these terms

Changes are made on this page, with a new date at the top of it. The terms in force on the day you bought are the terms that govern that purchase; a later change cannot be applied backwards to it.

For the free plan and the beta, continuing to use the application after a change means the new version applies.

Governing law

These terms are governed by the laws of the United Mexican States, and any dispute that cannot be settled by writing to each other goes to the competent courts of Mexico.

If you are a consumer, that does not take away the mandatory protections of the country you live in, or your right to bring a claim where you live. And because Dodo Payments is the seller of record, a complaint about the transaction itself — the charge, the invoice, the tax — is one they are answerable for as much as we are.
